D.C. Circuit Judge Janice Rogers Brown has written what I think will come to be seen as a very important concurring opinion in
Hettinga v. United States (D.C. Cir. Apr. 13, 2012), dealing with judicial scrutiny of economic legislation. Judge Brown advocates greater protection of economic freedom and, therefore, stricter judicial scrutiny of economic legislation favoring one faction over another.
